Terms and Conditions

These Terms and Conditions ("the Terms") are a binding agreement between you and Ashlonk governing your use of the Ashlonk app and the website ashlonk.com. They are formed and interpreted under the laws of the Republic of Iraq — first among them the Civil Code No. 40 of 1951 — and your electronic acceptance of them is valid under the Electronic Signature and Electronic Transactions Law No. 78 of 2012.

01Acceptance of the Terms

By creating an account or using the Service you confirm that you have read, understood and accepted these Terms together with the Privacy Policy, which forms part of them. Electronic acceptance produces its full legal effect under Law No. 78 of 2012. If you do not agree with any part of the Terms, please do not use the Service. You also confirm that you hold the legal capacity to contract, or that your guardian has consented, as set out in section 3.

02The Service

Ashlonk is a free messenger made in Baghdad: end-to-end encrypted chats, groups of up to 500 members, voice notes, voice and video calls, and media sharing — with no advertising. We may add, change or remove features to improve the Service.

03Eligibility and your account

  • You must be at least 13 years old to use the Service.
  • If you are under 18 — the age of majority under Articles 97 and 106 of the Civil Code — you need the consent of your parent or guardian to these Terms.
  • You register one account with a phone number you are entitled to use, and you provide accurate information.
  • You are responsible for your device, your verification codes and all activity under your account, and you must tell us promptly about any unauthorised use at support@ashlonk.com.

04Acceptable use

You agree not to use the Service to:

  • Break any law of the Republic of Iraq in force.
  • Defame or insult others (Articles 433 and 434 of the Penal Code No. 111 of 1969), or threaten or blackmail them (Articles 430–432 of the same code).
  • Violate the privacy of others — including publishing their photos, secrets or private correspondence without their consent (Article 17 of the Constitution; Article 438 of the Penal Code).
  • Commit, incite, finance or glorify terrorism (Anti-Terrorism Law No. 13 of 2005).
  • Infringe intellectual-property rights (Copyright Protection Law No. 3 of 1971, as amended).
  • Send spam or unsolicited bulk messages, defraud others, or impersonate any person or entity.
  • Spread malware, or probe, breach, overload or circumvent the security of the Service.

Group admins must take reasonable care to keep their groups within the law. We may act under section 8 against accounts that break this section.

05Your content

Everything you send stays yours. You grant Ashlonk only the limited technical licence needed to transmit your content, store it in encrypted form while undelivered, and deliver it — end-to-end encryption means we could not read it even if we wished to. You are solely responsible, legally, for the content you send. Remember that recipients control their own devices; choose whom you trust.

06Privacy

The Privacy Policy is an integral part of these Terms. Our standing commitment follows Article 40 of the Constitution: no monitoring, no wiretapping and no disclosure of your communications except under a binding judicial decision — and even then, end-to-end encrypted content is something we do not hold and cannot produce.

07Intellectual property

The app, its design, its logos and the marks "Ashlonk" and "أشلونك" are protected under the Copyright Protection Law No. 3 of 1971 (as amended) and the Trademarks and Commercial Data Law No. 21 of 1957 (as amended). We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app. You may not copy, modify or reverse-engineer the app except to the extent the law expressly permits.

08Suspension and termination

  • By you: stop using the Service at any time and delete your account from inside the app.
  • By us: we may restrict, suspend or terminate an account for a material or repeated breach of these Terms, to comply with a legal obligation, or to prevent serious harm — with notice where feasible. Your statutory rights under the Consumer Protection Law No. 1 of 2010 remain unaffected.

09Availability, changes and updates

The Service is provided as available. Quality can be affected by the networks you use — Ashlonk is built for weak signal, but no app can defeat a dead network — and by maintenance. We may release updates needed for security and compatibility. If we ever discontinue the Service entirely, we will give you reasonable advance notice.

10Liability

The Service is free of charge. To the maximum extent permitted by Iraqi law, we are not liable for indirect damages, for network failures, for the acts of third parties or for content exchanged between users. Nothing in these Terms excludes or limits our liability for our own fraud or gross fault — which cannot be excluded in advance under Article 259 of the Civil Code — or any other liability that the law does not allow to be excluded, and nothing reduces your mandatory rights as a consumer.

11Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control — force majeure, sudden events, acts of public authorities, war, or the failure of telecommunications infrastructure — in accordance with the Civil Code, including Articles 168 and 211.

12Changes to the Terms

We may amend these Terms. The amended version will be published on this page, and material changes will be announced inside the app at least 15 days before they take effect. Continuing to use the Service after that date constitutes acceptance; if you do not agree, stop using the Service and delete your account.

13Governing law and disputes

These Terms are governed by, and interpreted under, the laws of the Republic of Iraq. We will first seek to settle any dispute amicably: write to support@ashlonk.com and allow 30 days. Failing that, the competent courts of Baghdad have jurisdiction, without prejudice to any mandatory venue established in favour of consumers.

14General provisions

These Terms, with the Privacy Policy, are the entire agreement between us. If a competent court holds any clause invalid, the remaining clauses stay in force. Our not enforcing a right is not a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign them to a legal successor who remains bound by them. These Terms are issued in Arabic and English; in case of any divergence, the Arabic text prevails.
